Visualizing the larger role of members in the Alternative Dispute Redressal Mechanism, the Institute of Chartered Accountants of India is planning to launch a Certificate Course for Arbitrators. The Arbitration Rules of the Institute, Code of Ethics for the Arbitrators and Course Content of the Certificate Course for Arbitrators have been placed on the website of the Institute. The Institute is having its Headquarters at I.P. Marg, New Delhi-110 002 and has five Regional Councils at Mumbai, Chennai, Kolkata, New Delhi, Kanpur and more than 100 branches across the country. The Institute has also its Chapters outside India. The objective of this Certificate Course is to train the members to become Arbitrators/ Consultants/Representatives in the Alternative Dispute Redressal system. The broad course contents are as follows: -
- The Arbitration and Conciliation Act, 1996(including Domestic and International Commercial Arbitration)
- UNICITRAL Model Law on Arbitration and interpretation of Statutes
- Jurisprudential Aspects
- Code of Ethics of ICAI
- Relevant Provisions of:
- Indian Contract Act, 1872,
- Indian Partnership Act, 1932,
- Negotiable Instrument Act, 1881
- Sales of Good Act, 1930
- Information Technology Act, 2002
- Intellectual Property Rights (Trademark, Patent and Copyright); and
- Securities Contract Regulation Act, 1956
- Code of Ethics applicable to Arbitrators as per Alternative Dispute Redressal Cell, ICAI
- Standard Rules Applicable for Arbitrations as per Alternative Dispute Redressal Cell, ICAI
- Professional Duties of Arbitrators
- Drafting of Arbitration Award
- Post Award Issues
